State Governments allow certifiers to continue with cladding exemptions, but expose long-term risks.

State Governments are moving to enact bans on cladding and associated non-compliant building materials while protecting certifiers and building practitioners who would be otherwise ineligible to practice under insurance exclusions.

This proposed act however has been labelled as a temporary measure, as industry figures remain concerned over the expiry of Professional Indemnity Insurance which will occur for building practitioners in the next twelve months.

While Government intervention is likely to ease pressure in the short term, we find that this will create further issues in the following years. The shift in potential liability for uninsured practitioners has been warned as the catalyst to a market exodus, leaving those affected by building faults which may arise in future to be left without recourse.
