QLD – HENDRY building certifiers advise that the building regulations requires building owners, occupiers and managers of high occupancy buildings are required to appoint a fire safety advisor under the Building Fire Safety Regulations 2008 (BFSR). The BFSR requires the occupier of a high occupancy building to appoint a person who holds a current building fire safety qualification in the field of fire, evacuation procedures and emergency organisations as the designated fire safety advisor for the building.

Definition: High Occupancy Building: Fire Safety Advisor

Any of the following types of buildings are classified (as per building regulations and Building Code of Australia) as high occupancy buildings requiring a fire safety advisor per schedule 3 of the BFSR:

  • Class 2 or 3 building more than 25 metres in effective height;
  • Class 2, 3, 5, 6, 7b, 8, 9a or 9b building that is a workplace prescribed under the Workplace Health and Safety Regulation 1997 and where 30 or more workers are normally employed.
  • A Class 6 or 9b building that the Commissioner has decided is an at-risk licensed building under section 104KD of the Fire Service Act.

The Queensland Fire and Rescue Service (QFRS) recommends in multiple tenanted buildings a fire safety advisor be appointed for the whole building in consultation with tenants and the managing entity if there are common areas such as malls, common passageways or stairs, even if the managing entity does not employ 30 or more workers in the building. Individual tenants may wish to appoint their own fire safety advisor or utilise the fire safety advisor appointed by the Managing Entity, if there is a fire safety advisor, and they agree to do so. Either fire safety advisor is acceptable to the QFRS.

High Occupancy Building: Occupation: Building Regulations

The occupier or responsible entity will not be required to appoint a fire safety advisor under the BFSR for the building until 1 month after the commencement of occupation of the building. Notwithstanding this, it should be noted that occupiers are also currently responsible to ensure employees have been given adequate evacuation instructions within 2 days of starting work in a building under the Building Fire and Safety Regulations 2008 – a consultant fire safety advisor may be required.
