NT – HENDRY building surveyors advise that building legislation requires an applicant to consider the protection of adjoining property before building work commences. A number of steps usually have to be considered to comply with the protection of adjoining property legislation. Under Part 9 ‘Protection of Adjoining Property’ of the Building Act:

  1. “The owner of land or a building on or in which he or she is carrying out or proposes to carry out building work shall, in the prescribed circumstances, protect an adjoining property by carrying out protection of adjoining property works.”
  2. “A building certifier (building surveyor) must not grant a building permit for building work in the circumstances referred to in subsection (1) unless this Part is complied with”
