NSW – Emergency Plan advises property managers and real estate agents need to remind owners of multi-tenanted buildings of their duty of care under the NSW Occupational Health and Safety Act 2000 to provide a safe work place to tenants, visitors and tradespeople. This duty of care extends to a procedure to respond to emergencies (AS 3745-2010), and this procedure is also needed by the tenants to meet their duty of care to the staff they employ. This in part is provided by an emergency response training exercise, and is specified under AS 3745–2010 Planning for emergencies in facilities.

A building wide response to an emergency needs the cooperation and involvement of tenants and wardens to provide all with adequate emergency response training. To close the loop on this mutual dependence between the tenant and the owner, the lease agreements should include provision for tenants to co-operate with all emergency response measures under AS 3745-2010, including providing wardens for the Emergency Control Organisation and participation of all staff in trial evacuations. By ensuring the involvement of tenants, building owners can source an economical, building wide emergency response procedure and training regime that complies with AS 3745-2010.
