WA – HENDRY building surveyors advise that the Building Act 2011 requires a suitably qualified building surveyor to provide certificates of compliance for three distinct scenarios of building work, a Certificate of Design Compliance, a Certificate of Construction Compliance and a Certificate of Building Compliance.

A Certificate of Design Compliance under Section 19 of the Building Act 2011 will confirm that a proposed building or incidental structure diagrammatically achieves compliance with the Building Code of Australia. The Certificate of Design Compliance will be a pivotal aspect of the Building Permit Application submitted to the Permit Authority.

A Certificate of Construction Compliance under Section 56 of the Building Act 2011 will confirm that a building or incidental structure completed under a Building Permit physically achieves compliance with the Building Code of Australia. The Certificate of Construction Compliance will form the basis of an Occupancy Permit Application, which is to be approved by the Permit Authority prior to the building being occupied or used.

A Certificate of Building Compliance under Section 57 of the Building Act 2011 confirms that an existing building complies with the relevant building standards. This would be used to:

  • Apply for change of classification or change of use of an existing building via a new Occupancy Permit application submission to the Permit Authority; or
  • Confirm that an existing building complies with its original building permit/authorisation, and with the building standards that applied at the time of its construction; or
  • Confirm that an existing but unauthorised building complies with the relevant building standards.
