QLD – HENDRY building certifiers advise that the Sustainable Planning Act 2009 under Section 236 Self assessable development does not require a development permit for self assessable development. Although the owner is required to comply with applicable codes like, structural adequacy, size, volume and boundary set backs. 

Owners should be careful as some self assessable development work may still require to comply with the council local planning scheme, thus requiring a planning approval.

Schedule 1 Prescribed building work for Act, section 21, in the Building Regulations 2006 contains a full list of self assessable development work that does not require a development permit. Some nominated are:

  • small tool shed, stable or the like up to 10 square metres in area, other than in a tropical cyclone area
  • one metre high retaining wall (providing no loads are imposed above it, such as a building or driveway)
  • fence not more than two metres high (not including swimming pool fencing).
